On July 30, 2026, the Arizona Supreme Court ruled unanimously, reversing the 2025 Court of Appeals waiver revival. Holdings: the clergy-penitent privilege is a testimonial privilege separate from the reporting statute's exemption, and the exemption turns on the clergy's own religious determination of what is confidential — which courts cannot second-guess. Church lost its coverage suit against insurers over the reported $32M West Virginia settlement (Judge Tena Campbell, 2025). On May 20, 2026 the Church asked the 10th Circuit to restore coverage, arguing the Jensen claims were a single "occurrence."
